2. REED MIDEM’S INTELLECTUAL PROPERTY RIGHTS
Photo Bank’s contents in particular, and, without this list being exhaustive, its photographs, architecture, written text(s), graphics, illustrations, images, logos, website design, software and databases are the property of Reed MIDEM and/or of its related partners. Any use, including, but not limited to the reproduction, extraction , communication of the photographs present in the Photo Bank to third parties by any mean and notably in all formats (notably in downloadable formats including MP3, podcast or webcast), by all known or unknown processes, whether entirely or by extracts, on all existing or future material and immaterial carriers, without limitation, such as paper, optic, analogical, digital (CD, DVD) or on electronic networks(including on the Internet), and on any other promotional/marketing tools, is subject to the presence of the reference of the photo credits (name of Reed MIDEM’s partner or Reed MIDEM’s name........) on the photograph.All other rights of use are reserved and are subject to the previous written authorisation of Reed MIDEM or of its partners.
In accordance with Article L.122.4 of the French Intellectual Property Code, any unauthorized reproduction, communication to third parties, extraction, not expressly authorised, whether in whole or in part of the above-mentioned elements, by any process whatsoever, will be deemed an act of infringement of intellectual property rights or of unfair competition, as the case may be, and will be sanctioned accordingly.
3. RESTRICTIONS OF USE
You are not allowed to access Photo Bank online services by any means other than the interface that is provided by Reed MIDEM for use in accessing the Service.You agree not to use any part of Photo Bank services, through any means, for the purpose of exploiting commercially any part of said services.
- any damage arising from the erroneous, incomplete, objectionable character of the Content and its use,
- the management and the working order of the website receiving the Photo Bank , nor the Photo Bank
- the hosting of the website receiving the Photo Bank
- the storage, the safeguarding, the storing of the data
- the provision of the access and availability of the server
Reed MIDEM shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to loss of profits, goodwill, data, resulting, inter alia, from (i) the use or inability to use Photo Bank services; (ii) statements or conduct of Users or third parties in the course of accessing or using the services; interruptions of and difficulties in the operation of the services.
Reed MIDEM reserves the right to terminate a User’s access and use of Photo Bank services in some specific circumstances, such as, without limitation:
- Requests by law enforcement bodies;
- Technical or securities issues or problems;
- Occurrence of a force majeure event, …
You acknowledge and agree that Reed MIDEM shall not be held liable for terminations for cause to the terminated User or to any third-party.
7. COLLECTION AND USE OF PERSONAL DATA
7.1 - Information collected
Reed MIDEM collects personal data on Users, in accordance with the French Data Processing, Data Files and Individual Liberties Law dated January 6th, 1978 through, inter alia, paper and electronic forms used for participation to Reed MIDEM events, answers to satisfaction questionnaires and participation to surveys as run from time to time by Reed MIDEM, information supplied in the course of visiting Reed MIDEM websites, including information provided upon request by Reed MIDEM to allow it to answer queries on Reed MIDEM’s products and services.The personal data supplied by the Users is processed as follows: the Information includes Users’ names, addresses, telephone and fax numbers, e-mail addresses and other personal data related to professional activities. The data collected during a User's visit to Photo Bank is classed as “Information”.
7.2 - Use by Reed MIDEM of Information
Reed MIDEM uses Information and shares it on a need to know basis with other organisations, partners or contractors of Reed MIDEM, to enable or to facilitate the performance of contracts entered with the Users for the supply of the Services. Reed MIDEM may also have to disclose Business Information to comply with applicable law and/or court injunction, and to compel respect of rights, property and safety of Reed MIDEM or of third parties.
8. USERS RIGHTS
Rights guaranteed by the French Privacy Law
In accordance with the provisions of French law 78-17 dated January 6th, 1978 related to “Information Technology and Civil liberties” (Law No. 78-17 of 6 January 1978 amended by Law No. 2004-801 of 6 August 2004), if you have previously submitted personal data to Reed MIDEM, you have the right to access, rectify or object to the personal data relating to you. You may thereby require any information concerning yourself which would be untrue, incomplete, and ambiguous or obsolete, to be modified, completed, clarified, updated or deleted.If you wish to exercise that right, please writ to the following address: firstname.lastname@example.org.Please also note that once we receive your request, it may take up to 3 weeks to become effective.
Photo Bank managed by Reed MIDEM uses a secure server to protect personal data. You are fully responsible for maintaining the confidentiality of your password and abstaining from communicating it to any other person and you are solely liable for activities that occur under your password and login. Reed MIDEM disclaims all liabilities for inaccuracy of your personal data and in case of theft, loss, misuse, communication, fraudulent use of your login and password arising from your failure to comply with the above.
